TRADE TECH AND AIR CARGO ADVANCE SCREENING (ACAS)

U.S. Customs and Border Protection (CBP) has spent several years running a pilot program for air import shipments called Air Cargo Advance Screening (ACAS).

ACAS has evolved from a voluntary pilot to a mandatory filing that requires air carriers to send and receive advance security filing data for airfreight through CBP’s Automated Targeting System. The program is currently live and CBP has announced that penalties begin on June 11, 2019.

CBP’s goal with the pilot is to strengthen its capability to target high-risk cargo earlier in the supply chain and provide an opportunity for members of the air cargo community to participate and prepare for eventual regulatory changes.  Pilot participants from the air cargo community are in the process of testing via the pilot program.

South Africa RCG Filing

The South Africa Revenue Service (SARS) requires the filing of certain information for shipments destined to South Africa. The required filing is known as RCG which is an acronym for Reporting of Conveyances and Goods.

The RCG filing is a 24 hour Advance Manifest Rule, all exports to South Africa or transshipments through South African ports. All relevant manifest information must be electronically submitted to South African Customs within 24 hours prior loading of the first container at load port that will transport the goods to or via South Africa.

CBSA EMANIFEST ANNOUNCEMENT OF POSTPONEMENT

As Trade Tech has anticipated for some time now, the Canada Border Services Agency (CBSA) has announced a postponement of the penalty period for lack of a filing or for an improper eManifest filing. The delay is caused by the CBSA's discovery of substantial issues with major supply chain partners in Canada that must be resolved for the processing of shipments.  The CBSA posted CN17-15, which outlines the revised implementation timelines. Until systems are robust and tested, eHBL remains voluntary. The CBSA CN17-15 is posted below for your information. 

"A new voluntary period will begin immediately and will be in place for a period of at least one year. During this period, no penalties for non-compliance will be issued regarding pre-arrival submission of house bills. Freight forwarders who are transmitting electronic house bills may receive report cards from the CBSA with respect to data quality within their transmissions."

Trade Tech customers may file with Trade Tech using either filing type and we recommend that importers become familiar with the requirements for eManifest as it will be the sole filing type allowed in the future.  We note that eManifest filings may require manual workarounds in some cases.

Canadians change course on import requirements last minute

The Canada Border Services Agency (CBSA) has announced a last-minute change in the eManifest filing requirement. As you are aware, we are nearing the end of the first of three implementation phases for eManifest. The non-monetary enforcement phase begins in January 2017. On December 6, 2016, CBSA issued Customs Notice 16-29.This is a significant announcement and change by CBSA. Prior to this announcement, only Canadian-based Freight Forwarders (FFs) could be bonded and only those bonded FFs could move cargo that was required to be moved in bond in Canada and only those could file advance consolidated HBLs. Now, the opportunity is open to FFs from any domicile around the world to become bonded to simplify Canadian imports.

Canada eManifest House BL filing requirement took effect on November 7th, 2016

Forwarders/NVOCC’s importing cargo into Canada must comply with a new electronic House BL filing requirement.  We are currently in the second phase of Canada Border Services Agency's (CBSA) implementation schedule:

November 7, 2016 to January 10, 2017 - Initial Transition period.

January 11, 2017 to June 30, 2018 - Initial enforcement with notices sent to filing parties, but no penalties will be issued.  During this period, parties are compliant by filing either eManifest or ACI.

July 1, 2018 - Final enforcement period where penalties will be issued for non-compliance.
